What is a Third Party Debt Order?

A Third Party Debt Order or TPDO is a one of a range of enforcement options you have against debtors who are in breach of a County Court Judgement ordering them to pay your balance.

A Third Party Debt Order is most often use to ‘Ring Fence’ a debtors bank account. The account the Third Party Debt Order is taken out against is suspended – the debtor cannot access or withdraw any funds contained within without the express permission of the court. A further hearing is then held to determine how to ultimately resolve the debt.

What rights does a debtor have?

A debtor can dispute a Third Party Debt Order up to 3 days prior to the court hearing. Should a debtor dispute the TPDO, they will have to attend the court hearing and a judge will make the decision as to whether to proceed with the Third Party Debt Order.

While the account is frozen, a debtor can still request withdrawals with permission from the court – For example, if they can demonstrate to a judges satisfaction that the freezing of an account will directly cause hardship to third party, such as a child.

When is a Third Party Debt Order appropriate?

When a debtor has sufficient assets to clear the debt within a bank account, and is providing no legitimate legal reason for withholding payment. A TPDO ensures that the funds to pay you are secured and that you will recover the full amount as dictated by the court.
